Software and Data Processing Terms

These Software and Data Processing Terms ("Data Terms") supplement the Mirrormapper End User Licence Agreement ("EULA"). They explain how we handle data across cloud services, local / on-device processing, third-party platforms we resell or bundle (including MapShare and manufacturer apps), and software we develop or provide in beta.

If you do not agree, do not use the Software. For personal information, the Privacy Policy also applies. If these Data Terms conflict with the EULA on a processing topic, these Data Terms prevail for that topic. Sale of licences remains governed by the Terms of Sale.

Nothing here excludes non-excludable rights under the Australian Consumer Law.

1 Scope of software

These Data Terms cover:

Hardware sales and equipment hire are separate (Terms of Sale; Master Equipment Hire Terms). Professional consulting is under the Professional Services Agreement.

2 Roles

2.1 You own Customer Data you create or upload (imagery, point clouds, orthomosaics, annotations, flight logs, project metadata), subject to manufacturer or third-party platform terms where that platform is the host.

2.2 We process Customer Data to provide, secure, support, and improve the Software as described in the EULA and these Data Terms.

2.3 For personal information, we act in accordance with the Privacy Act 1988 (Cth) and our Privacy Policy. Where you upload personal information of others (faces, plates, private property), you are responsible for lawful collection and notices.

3 Cloud services (Mirrormapper-hosted)

3.1 Customer Data uploaded to our SaaS is stored and processed on infrastructure we control or contract (primarily Australia where practicable; see Privacy Policy on overseas processors).

3.2 We use Customer Data to:

  • provide the subscribed features (storage, processing jobs, sharing links you enable, collaboration);
  • secure accounts, prevent abuse, and troubleshoot;
  • generate de-identified or aggregated metrics to improve products;
  • train or improve Mirrormapper models only as allowed by the EULA, your plan, or a written agreement (we do not sell raw Customer Data; we do not use Customer Data to train third-party foundation models without your consent).

3.3 You control sharing: public or recipient links you create may expose Customer Data to anyone with the link. Choose access controls carefully.

3.4 Retention: while your subscription is active and for a limited period after cancellation as stated in the EULA / plan (typically up to 90 days unless law or a dispute requires longer). Export before cancellation.

3.5 We implement technical and organisational measures described in our Information Security Policy. No cloud service is risk-free.

4 Local and on-device processing

4.1 Where Software runs on your computer, scanner, drone controller, or private server, processing occurs under your control. We do not automatically receive your full datasets unless you upload, sync, or enable telemetry.

4.2 Local processing outputs (e.g. point clouds written to disk or SD card) remain on media you control until you choose to upload or share them.

4.3 You are responsible for:

  • securing devices, disks, and backups;
  • complying with privacy and workplace rules for data captured on site;
  • wiping hire devices and removable media before return (we may also wipe on return).

4.4 Optional sync features (upload to our cloud, MapShare, or manufacturer cloud) are off or user-initiated unless the product documentation states otherwise. Enabling sync is your instruction to transmit Customer Data to that destination.

4.5 Thermalmapper and other free desktop apps. Processing of the job (R-JPEGs, `.tmap` files, reports) stays on your PC. Map tiles and weather lookup (Open-Meteo) go online because those services need a network. That is not an upload of your project.

4.6 Usage Data (not Customer Data). Where enabled, Installed Software may send: application version, operating system, a random install identifier, counts of features used (for example open project, export PDF), error and crash reports, and camera or file-type models read from file metadata. We do not receive imagery, radiometric values, GPS of findings, report text, client names, or project files as Usage Data. You can turn Usage Data off in Settings when the product offers that control.

4.7 Optional email, no login. We may already have your email from the website download form. The app may ask again on first run so we can match this install to that download and send product notices. You can skip that prompt. The app still runs. There is no password and no account. We will not hard-gate Thermalmapper behind an email field.

4.8 Software feedback. Notes you send at mirrormapper.com.au/pages/software-feedback, in an installer email, or by email to support@, are Feedback under the EULA. Do not attach Customer Data unless we ask for a sample.

5 Hybrid workflows

Many jobs use both local and cloud steps (e.g. capture and process locally, deliver via MapShare or Landmapper). Each hop is subject to the terms of the system that receives the data. Check destinations before you upload.

6 MapShare and other bundled third-party platforms

6.1 SHARE scanners may include a MapShare allowance (e.g. storage for a period). MapShare is operated by its provider, not by Mirror Mapper Pty Ltd as the host.

6.2 Your use of MapShare is subject to MapShare’s terms and privacy policy. We are not responsible for MapShare availability, security incidents on MapShare’s systems, or link sharing you configure there.

6.3 We may assist with setup as a reseller / integrator. That assistance does not make us the data host of MapShare content.

7 Manufacturer software and clouds

DJI, SHARE, and other manufacturer applications and clouds are governed by those manufacturers’ terms. Data you upload to manufacturer clouds is processed by them. Our Privacy Policy and these Data Terms cover our systems; review manufacturer policies for theirs.

8 Custom AI, models, and development software

8.1 We develop and may supply custom detectors, classifiers, processing pipelines, and integration software (including for docks and enterprise workflows).

8.2 Unless a written SOW says otherwise:

  • models and code we create remain our intellectual property;
  • you receive a licence to use deliverables for your internal business during the agreed term;
  • training data you supply remains yours; we use it only to build and support your deliverable, and for de-identified improvement if your agreement allows.

8.3 Beta and pre-release tools may log additional diagnostics. Do not use them as the sole system for safety-critical decisions. See EULA beta terms and Privacy Policy §13.

9 Hire equipment and data

9.1 Data captured on hired Equipment is your responsibility during the Hire Period.

9.2 On return we may factory-reset devices and revoke hire software seats. Do not rely on hired hardware as your only backup.

9.3 Master Equipment Hire Terms apply in addition to these Data Terms for hired units.

10 Security incident notice

If we become aware of a breach of security leading to accidental or unlawful destruction, loss, alteration, or unauthorised disclosure of or access to Customer Data we host, we will notify you without undue delay where required by law or contract, and take reasonable steps to investigate and mitigate. Your notification contacts should be kept current on your account.

11 Your obligations

You must not upload unlawful content; must not attempt to break security; must keep credentials safe; must configure sharing appropriately; and must ensure you have rights to process and upload Customer Data (including site access and privacy consents where required).

12 Liability

Liability for Software is as set out in the EULA and Terms of Sale, subject to the ACL. We are not liable for loss arising from local storage failure, your sharing settings, third-party platforms (MapShare, manufacturers), or carrier/network failure beyond our reasonable control.

13 Changes

We may update these Data Terms by publishing a new version on mirrormapper.com.au. Material changes will be notified as described in the EULA. Continued use after the effective date constitutes acceptance for ongoing Software use.
